Merchant License

1.1This license is an agreement between Glintworks and the holder of an active, paid Merchant membership on Glintworks' Patreon (the "Licensee"). It starts when the first payment succeeds. By joining the Merchant tier, the Licensee accepts the version of this license in force at that time.

1.2The Licensee confirms they use this license for their trade or business. If the Licensee is nonetheless a consumer, their mandatory consumer rights remain unaffected.

1.3"Design" means one product of the Glintworks catalogue, including all its variants and parts. The license covers every Design Glintworks publishes, including those published during the membership, as long as the Licensee lawfully obtained its files from Glintworks: through the membership, from our webshop or from one of our official shops on other platforms.

1.4This license adds to the license that came with each file (Glintworks Personal Use, or the license of the platform the file was bought on). While it's active, it governs commercial use; otherwise the file's own license applies.

2.1Print the Designs in any material, colour and scale, and sell the prints to end customers, online or offline, anywhere.

2.2Sell up to 120 prints per Design per membership year. A membership year starts on the day the membership started and on each anniversary. A "print" is one item, or one set sold as a single product. Prints made for you by a print service (2.5) count. Unused prints don't carry over.

2.3Paint, assemble or finish prints, and sell them finished or as kits.

2.4Change the files to suit your printers and materials, and sell prints of the changed files under this license.

2.5Print on printers you or your business own or operate; your staff may run them. An independent print service may print your own orders if, before getting the files, it agrees in writing (a message or email is enough) to use them only for your order, not keep or share them, and delete them afterwards. The print service gets no license. You remain responsible for it.

3.1Share, sell, upload or pass on the files in any form (original, changed, converted or sliced, e.g. STL, 3MF, gcode), in whole or in part, not even for free. That includes public or shared folders and print-on-demand services that take a file.

3.2Sell more than 120 prints of a Design per membership year, or produce at business scale: print farms, production for wholesale, or supply to retailers. Also no moulds, casting or injection moulding. All of these need a Production License (section 9).

3.3Scan, photograph or otherwise copy prints to recreate a Design as a new file, or publish a design that substantially reproduces a Design, whether made from the files or from scratch.

3.4Present the Designs as your own, or suggest that Glintworks made, endorses or partners with your business. Where a platform or the law asks for the designer, "Design: Glintworks" is enough.

3.5Use Glintworks photos, renders, listing texts, name or logo to sell your items.

3.6Use the files, the Designs or pictures of them to train AI, or upload them to AI tools. Glintworks reserves its rights against text and data mining (§ 42h UrhG, Art. 4 Directive (EU) 2019/790).

3.7Transfer or sublicense this license, or share your membership account.

4.1You follow the rules of the places and platforms where you sell. Whether a platform accepts prints made under a license is for you to check; Glintworks makes no promise that any platform does.

4.2You are the manufacturer of your prints. You are responsible for their quality and safety and for the rules that apply to them, such as the General Product Safety Regulation (EU) 2023/988, and the toy safety rules if a print is a toy. You may not name Glintworks as the manufacturer.

4.3You keep a simple record of how many prints of each Design you sold in each membership year, and show it to Glintworks on request.

5.1Your rights under section 2 apply only while the membership is active and paid.

5.2When it ends for any reason other than section 8 (cancellation, failed payment), you may, for 30 days, sell prints you already made and fulfil orders accepted before it ended. You may not make new prints for sale. After the 30 days, take down all listings of the Designs.

5.3You may keep and use files you already have under the license that came with them, usually Personal Use.

5.4Prints already sold stay with their buyers. Buyers get no rights to the files.

6.1Glintworks may change this license for changes in the law, in platform rules or in the kinds of Designs it publishes. The new version is announced to members at least 30 days before it takes effect. If you continue the membership after that date, you accept it; you may cancel before then, and section 5 applies. Prints already sold are unaffected.

6.2A Design removed from the catalogue may still be printed and sold under this license, as long as you got its files before it was removed.

6.3Every version stays readable at its own address. Glintworks records which version each member accepted.

7.1Each Licensee gets a license ID. You may show it to customers and marketplaces as proof of your license.

7.2If you agree, Glintworks lists your business name, license ID and, if you want, a link to your shop on its public list of licensed sellers. You can withdraw that agreement at any time, and you'll be taken off the list. See our privacy notice: https://glintworks.com/privacy

7.3The license ID lapses at the end of the period in 5.2, or at once under section 8.

8.1A breach of 3.1, 3.2, 3.3 or 3.6 ends this license at once. Any other breach ends it if not fixed within 7 days of our written notice.

8.2If the license ends because of a breach, section 5.2 doesn't apply. Glintworks may remove you from the membership. Refunds follow Patreon's terms.

8.3Glintworks may report infringing listings to marketplaces. Our other rights and claims remain unaffected.

9.1Anything under 3.2 needs a Production License, agreed individually in writing. Message us.

10.1If a file is faulty, message us and we will fix or replace it. Glintworks doesn't promise that a file suits a particular purpose, printer, material or load.

10.2Glintworks is not liable for production failures, material costs or lost profits. Otherwise, liability for slight negligence is limited to the membership fees the Licensee paid in the 12 months before the damage. Liability for personal injury, for damage caused intentionally or through gross negligence, and under product liability law remains unaffected.

10.3You indemnify Glintworks against claims by your customers or authorities caused by your production or sale.

11.1Austrian law applies, excluding its conflict-of-law rules. Place of jurisdiction is the court with subject-matter jurisdiction for Glintworks' seat; Glintworks may also sue at the Licensee's seat.

11.2Patreon's terms govern membership, billing, VAT and refunds. This license governs the use of the Designs. The Designs stay protected by copyright and design rights, which remain with Glintworks.

11.3If a provision is invalid, the rest stays in force. Not enforcing a provision waives nothing.
